In reply to Your Excellency's letter of the 22nd instant, I have the honour to transmit the enclosed copy of a minute by the Attorney General to whom I had already referred the question of the interpretation to be put upon Clause III sub-clause 1 of the Order-in-Council of 26th October, 1896. Your Excellency is aware that I share the Attorney General's

view.

Although it is not possible that the difference of opinion between us should lead to any want of co-operation in emergency still I concur with Your Excellency that it is

desirable to refer the question to the Secretary of State for the Colonies and I propose, therefore, to send your letter and this reply to him for his consideration.
